The German legal website JUVE has reported it is highly likely that the UK will announce later today its intention to ratify the Unified Patent Court Agreement. JUVE says it has heard this from reliable sources in London, or in German ‘gut unterrichteten Londoner Kreisen’.
An official announcement of the UK on its (non)participation in the Unitary Patent system is expected later today (after 4 p.m. European time) during the meeting of the EU Competitiveness Council in Brussels.
If the UK ratifies the UPCA indeed, it means an end to the uncertainty about the future of the Unitary Patent system, which had risen due to the Brexit vote of 23 June 2016. The UK is one of the mandatory ratifiers of the Agreement, but it was very uncertain whether it would still be willing to ratify after the vote for a less European UK.
